IMPORTANT NOTE

Everything contained in the Terms of Use is important and must be read in full. However, we wish to draw your attention specifically to the clauses below, which may have a significant impact on your rights and obligations. • Maximum winnings limit: Payout caps apply to certain Services, regardless of the stake or apparent win (see Clause 8).
  • Errors and software issues: In cases of technical faults or pricing errors, including undetectable system malfunctions, we may void results and withhold payouts (see Clauses 10 and 18).
  • Fraud, cheating, and prohibited activity: Engaging in suspicious or prohibited behavior may result in suspension, forfeiture of funds, and further action (see Clauses 11, 12, and 13).
  • Liability limitations: Our liability is limited in specific ways, especially in relation to regulatory obligations and safer gambling duties (see Clauses 16.1 – 16.4).

2. These General Terms, the Terms of Use, and Your Relationship with Clear Play Analysis

2.1 Not all of the legal terms and conditions that apply between you and us are set out in these General Terms – some of them are contained in separate documents to avoid making these General Terms too lengthy. We refer to these other documents and provide links to them at the appropriate places. These documents are still important and form part of the legal agreement between you and us, and you should read and understand them as thoroughly as these General Terms. These referenced terms, together with these General Terms, constitute the “Terms of Use” as defined herein and include the items listed in clause 2.2.

2.2 By visiting the Clear Play Analysis website and (if applicable) by registering for an Account and/or otherwise using or accessing any of the Services, you agree to and are legally bound by the following:

  • 2.2.1 These General Terms;
  • 2.2.2 Clear Play Analysis Gaming Conditions of Use;
  • 2.2.3 Clear Play Analysis Community Conditions of Use;
  • 2.2.4 Clear Play Analysis Live Video Conditions of Use;
  • 2.2.5 Standard Promotional Terms;
  • 2.2.6 Exchange Rules and Regulations;
  • 2.2.7 Sportsbook Rules and Regulations;
  • 2.2.8 Clear Play Analysis Fees and Charges.

2.3 If there is any conflict or inconsistency between these General Terms and any of the other documents that form part of the Terms of Use, these General Terms shall take precedence to the extent of the conflict or inconsistency.

3. Amending the Terms of Use

3.1 We may amend the Terms of Use from time to time for various reasons including (without limitation) commercial purposes, compliance with laws or regulations, guidance or instructions from regulatory bodies, or customer service reasons (e.g., to reflect updates to the Services).

3.2 If we make material changes to the Terms of Use, we will provide you with as much prior notice as reasonably practicable. In all cases, customers will be notified of material changes before they take effect. Notifications may be delivered via pop-up messages on our website or mobile app upon login and/or by email. Your continued use of the Services after the changes are made (and where applicable, notified to you) will constitute your acceptance of the changes. If you do not agree with any changes, you must stop using the Services, but you may still withdraw your funds (subject to any withholding rights outlined in the Terms of Use).

3.3 The effective date of each applicable document that forms part of the current Terms of Use will be stated at the bottom of the relevant page(s).

4. Account Eligibility

4.1 To use the Services, you will need to register and open an account ("Account") with us. In order to register an Account, you promise and confirm to us that:

  • 4.1.1 You are at least 18 years of age (underage gambling is a criminal offence in certain jurisdictions);
  • 4.1.2 You are of sound mind and capable of entering into a legally binding agreement with us;
  • 4.1.3 You will provide accurate registration information, including your date of birth, country of residence, address, email, and phone number, and agree to update us promptly if any of these change;

4.3 You are responsible for keeping your Account details up-to-date to ensure you receive all communications.

4.4 You are solely responsible for the security and confidentiality of your Account credentials. Use of an email address as a username may lower your Account security. Keep your credentials private at all times.

4.5 We are entitled to assume any actions made using your correct login credentials are authorized by you. Change your password regularly and safeguard your Account as you would a bank card. You are fully responsible for all activity under your Account unless we are negligent.

5. Account Verification and Due Diligence

5.1 The following information must be provided during the Account registration process:

  • Valid mobile number
  • Date of birth
  • First and last name
  • Full residential address
  • Valid email address
  • A chosen password

5.2 We will verify your age in accordance with our legal obligations. You may be asked for proof of age and/or address. If you're located in jurisdictions such as Great Britain, Northern Ireland, the Channel Islands or the Isle of Man, you will not be able to gamble until we confirm your identity, address, and age. If we later discover you're under 18, we will void all bets, refund your net losses, and may report the matter to relevant authorities.

5.3 You must ensure that all details submitted during registration are complete, accurate, and up to date. You authorise us to carry out necessary identification and verification checks. You agree to fully cooperate with these checks and provide all requested information.

5.4 We will attempt to verify your identity electronically. If that is not possible or inconclusive, you may be required to submit identity documentation. For non-UK customers, identity checks may be triggered during registration, at specific deposit levels, or based on other regulatory triggers. See our documentation guide for accepted ID documents.

5.5 As a licensed operator, we are obligated to carry out checks throughout the lifetime of your Account. This may include verifying your source of funds. For a list of required documentation in such cases, please visit our KYC documentation guide.

5.6 If you fail to provide requested information, we may restrict your Account, including blocking bets, access to the Services, and withdrawals. Your Account may also be suspended or permanently closed per clause 13.

5.7 All transactions are subject to anti-money laundering checks. Any suspicious activity may be reported to relevant authorities.

5.8 We may share your details with authorised third parties to confirm your age, identity, and payment details. These parties will retain a record of any checks made using public or private databases.

5.9 Due to regulatory requirements, your session may be timed out following a period of inactivity. Please do not leave your session unattended.

5.10 All personal information provided during registration will be processed in accordance with our Privacy Policy.

6. Duplicate Accounts

6.1 You may only register and maintain a single Account with Clear Play Analysis. Any additional Account(s) opened by you will be considered a "Duplicate Account". If we determine that you hold one or more Duplicate Accounts, we reserve the right to take the following actions in relation to each Duplicate Account:

  • 6.1.1 Close any Duplicate Account(s), or your original Account, as applicable—leaving you with only one valid Account. If we suspect deliberate or fraudulent behavior, we may close all of your Accounts.
  • 6.1.2 Void any bonuses, promotions, or free bets associated with the Duplicate Account, along with any winnings derived from them.
  • 6.1.3 Void all future Bets placed via the Duplicate Account.

7. Deposits, Protection of Your Funds, and Withdrawals

Deposits and Protection of Your Funds

7.1 In order to place bets or participate in games for real money, you are required to deposit funds into your Account. Except as outlined below, all customer funds are held securely by The Sporting Exchange (Clients) Limited (the "Trustee"), which is a group company designated specifically for the safekeeping of customer funds, in accordance with the terms of a Trust Deed (the "Trust Fund"). This arrangement provides the following protections:

  • 7.1.1 If Clear Play Analysis or another related entity becomes insolvent, your funds will not be accessible to liquidators or administrators. You will still be able to withdraw your balance, except where the Terms of Use otherwise allow us to withhold funds.
  • 7.1.2 The Trust is governed by the law of equity, offering customers (as beneficiaries) protections not typically available in standard contractual relationships, such as fiduciary duties to act in good faith.
  • 7.1.3 We maintain additional operational controls to safeguard the Trust Fund and your money.

7.2 This fund protection structure is classified as providing "high protection" under the standards set by the Gambling Commission. You can read more at: Gambling Commission Customer Funds Guide .

7.3 Your funds will not be held by the Trustee under certain conditions:

  • (i) if legally required to be held in a separate non set-off bank account in the licensee's name; or
  • (ii) if deposited via a third-party Payment Provider.

Funds deposited via a Payment Provider (such as e-wallets) may experience a delay before they are secured under the Trust Fund, and will remain outside of its protections during that interim period. Deposits made using bank transfers, cheques, credit cards, or debit cards are not classified as third-party Payment Provider deposits.

7.4 Funds in your Account are held as a form of security for any financial obligations you may incur while using our betting or gaming services. Further details on trust operations are found in the Trust Deed.

7.5 You acknowledge that you are not entitled to interest on your deposits (see clause 5 of our Trust Deed for details), and that Clear Play Analysis is not to be treated as a banking institution.

7.6 Available deposit methods can be viewed by logging into your Account and selecting the "Deposit" button at the top right-hand side of the homepage. For full details, visit our Deposit Methods page.

Withdrawals

7.7 You may request to withdraw funds from your Account at any time, subject to the following conditions:

  • 7.7.1 All payments into your Account must have been cleared and not subject to chargebacks, reversals, or cancellations.
  • 7.7.2 We must have completed all required verification checks to our satisfaction (see clause 5). Delays in providing requested information may result in delays in withdrawal processing.
  • 7.7.3 There must be no ongoing or concluded investigations into any of the following:
    • Suspicious or irregular betting patterns, potential match-fixing, or cheating (see clause 12);
    • Money laundering, terrorist financing, or use of criminal proceeds for gambling;
    • Any error, malfunction, or interruption relating to Services you have participated in (see clause 10);
    • Illegal or Prohibited Activities (as defined in clause 11).

In such circumstances, as outlined in the “Important Note” above, we reserve the right to withhold funds, void affected transactions, close your Account, and report the matter to law enforcement or relevant authorities, depending on the situation.

7.8 You can withdraw funds via the following methods:

  • Mobile: Tap on your "My Account" icon, select "Withdraw", then choose your preferred payment method.
  • Desktop: Click "My Clear Play Analysis Account" in the menu and then select "Withdraw".

Funds may be withdrawn from your “Main Wallet”. However, funds in “Sportsbook Bonus”, “Casino Bonus” or “Exchange Game Bonus” may require completion of applicable wagering requirements. Learn more about Casino wagering requirements.

7.9 Withdrawals will usually be sent back to the original funding source or linked bank account. For more info, click here.

7.10 Processing times for deposits and withdrawals vary depending on the payment method. For detailed timeframes, click here.

7.11 Please note: For users located in England, Scotland, Wales, Northern Ireland, Isle of Man, Jersey, and Guernsey – credit cards are not permitted for deposits or withdrawals. Any reference to credit cards elsewhere in these Terms does not apply to these regions.

8. Maximum Winnings Limits

8.1 As stated in the "Important Note" above, maximum winnings limits apply to some of our Services. These limits apply regardless of the size of your stake. The maximum winnings allowed per Account are as follows:

  • 8.1.1 For sports betting transactions placed via the Services: The maximum payout to a single customer within any 24-hour period is outlined in our Sportsbook Rules and Regulations. For currencies not listed, the equivalent value will apply.
  • 8.1.2 For gaming services: The maximum winnings for any individual wager or game play are defined in the applicable Clear Play Analysis Gaming Conditions of Use and/or the specific rules of the game.

8.2 While we aim to block any Bets that could exceed the maximum payout limits, technical limitations may occasionally allow such Bets to be placed. It is your responsibility to check the maximum limits applicable to each Service. If the potential winnings exceed £/€1,000, we strongly advise reviewing the relevant Service rules before placing a Bet. Regardless of the amount staked or the calculated payout, winnings will be capped at the stated limit.

9. Privacy and Cookies

Your personal information is handled in line with our Privacy Policy. Our use of cookies and related technologies is detailed in our Cookie Policy, which explains how we collect and use data via the Services.

10. Errors, Malfunctions, and Interruptions

10.1 Clear Play Analysis makes every effort to ensure that no errors are made in prices offered or bets accepted. However, human and/or systems error may occasionally result in errors.

10.2 This clause outlines potential issues that can arise, as well as our rights in such circumstances. Nothing in this clause overrides any legal rights you may have under applicable consumer laws and regulations.

10.3 Key definitions:

  • Malfunction: Any human error or automated process failure that causes a deviation from the intended performance of the Services. This includes software errors, interface failures, and unintended outcomes. These may not always be immediately apparent and can be discovered during later review of transactions or game outcomes.
  • Error: Mistakes not exclusively technical, such as incorrect odds, pricing errors, or promotional offer discrepancies. Examples include a bet posted at an unrealistic price, a misconfigured promotion, or incorrect payout tables.
  • Interruption: Any disruption in a gambling transaction due to issues such as internet failure, latency, or other unforeseen technical issues that interrupt service continuity.

10.4 If any of the above circumstances occur, we will address them in accordance with our policies and this Agreement. It is important that you understand and agree to this clause before using the Services, as outlined in the 'Important Note' at the start of these General Terms.

Malfunctions

10.5 If your Account is credited with winnings due to a Malfunction, we reserve the right to void the transaction and withhold the winnings. This applies even if the product could have produced similar winnings without the Malfunction. If winnings were paid out or withdrawn in such cases, you agree to return them upon demand, as they will be held on trust for us.

10.6 If a Malfunction becomes apparent or you suspect one may be occurring, you must stop using the affected Service immediately and report it to us without delay.

Errors

10.7 In the case of an Error, the same remedies apply as with Malfunctions. For sports betting specifically, if price transmission errors occur (e.g., obvious or blatant odds errors), we may settle bets at the correct market price or Starting Price (for horse racing), whichever is greater.

10.8 If an Error becomes apparent or you suspect one may be occurring, you must stop using the affected Service immediately and notify us without delay.

Interruptions

10.9 We strive to resolve Interruptions in a fair manner that avoids systematic customer disadvantage.

10.10 For betting: We may suspend betting markets, void bets, and refund stakes in the event of an Interruption.

10.11 For gaming:

  • If the gamble is submitted and you can no longer influence the result, the result will stand.
  • If the Interruption occurs before the outcome is generated in a single-stage event, your stake will be refunded.
  • If the game has multiple stages or decision points, we will attempt to restore it to the last known state to allow completion.
  • For multiplayer games, we will act reasonably and resolve outcomes on a case-by-case basis.
  • For progressive jackpot games, jackpot values will be restored to their pre-failure state, where within our control.

11. Prohibited Activities

11.1 You may only use the Services, including your Account, for lawful gambling in accordance with these General Terms. You may not engage in any activity which we define below as a "Prohibited Activity". You acknowledge and understand that consequences of doing so may include voiding of transactions, withholding of winnings, and suspension and/or closure of your Account.

11.2 The following activities are considered "Prohibited Activities":

  • 11.2.1 The name on your Account does not match the name on your bank or payment card.
  • 11.2.2 You are depositing or withdrawing without genuine play.
  • 11.2.3 You access the Services from a Prohibited Territory, use a VPN, or hide your IP address to disguise your location.
  • 11.2.4 You initiate a charge-back or return on a deposit transaction.
  • 11.2.5 You use the Services for any purpose other than your personal recreational use, including acting on behalf of others.
  • 11.2.6 You deposit funds originating from illegal activity or unauthorised sources.
  • 11.2.7 You provide incorrect or misleading information during registration.
  • 11.2.8 You allow another person to use your Account, intentionally or not.
  • 11.2.9 You open or use one or more Duplicate Accounts deliberately or fraudulently.
  • 11.2.10 You attempt to bet without sufficient cleared funds in your Account.
  • 11.2.11 You engage in fraud, cheating, collusion, money laundering, exploitation of errors or malfunctions, use of unfair software, or other illegal/improper conduct.
  • 11.2.12 You use the Services in breach of local law.
  • 11.2.13 Your Account is used in a way that constitutes "business usage" (e.g., by betting operators or data suppliers).
  • 11.2.14 You are contractually or professionally prohibited from betting.
  • 11.2.15 You place a bet on an event in which you are a participant.
  • 11.2.16 You manipulate a market to disrupt the integrity of the Exchange.
  • 11.2.17 You assist third parties with betting (e.g., "courtsiding") from territories where betting is illegal.
  • 11.2.18 You arrange for a third party to assist with betting in breach of territorial laws.
  • 11.2.19 You match Exchange bets against your own or related accounts to manipulate markets.
  • 11.2.20 You use the Exchange to deliberately transfer funds between accounts via collusion.
  • 11.2.21 You become bankrupt, default on judgments, or have assets seized.
  • 11.2.22 You breach promotional terms (e.g., by opening multiple accounts for a promotion).
  • 11.2.23 You engage in abusive or inappropriate behaviour toward other users or staff.
  • 11.2.24 You breach the Terms of Use in a serious or material way.
  • 11.2.25 You engage in any of the above Prohibited Activities on another gambling site, including sites operated by our affiliates.

12. Suspicious Betting

12.1 For the purposes of this clause, "suspicious betting" refers to situations where we have reasonable grounds to believe that a Bet or series of Bets have been placed under suspicious circumstances. Suspicious betting includes, but is not limited to:

  • 12.1.1 An unusually high frequency or pattern of Bets on the same selection(s) in a short time period.
  • 12.1.2 Betting patterns where the theoretical probability of the selection(s) winning based on the odds offered at the time of placement is significantly inconsistent with the probability based on the starting prices.
  • 12.1.3 Questions around the integrity of the event, including where a participant shows exceptional performance that was known to the bettor but not the public.
  • 12.1.4 Bets placed by automated means or not manually by the Account holder (excluding API usage).
  • 12.1.5 The use of external unfair factors or influences relating to the event(s).
  • 12.1.6 Suspected use of Duplicate Accounts or accounts under common control to disguise the value, nature, or pattern of betting activity.
  • 12.1.7 Acting in concert with others, or acting on behalf of someone else.
  • 12.1.8 Bets placed from a device or location that contradicts the declared details of the Account holder.
  • 12.1.9 Betting patterns in which multiple Bets are placed in quick succession by the same or different users that result in a total liability that significantly exceeds historical betting norms (e.g., a liability over £100,000 on similar selections between 9:30 PM and 8:00 AM).

12.2 If we discover or reasonably believe that you have engaged in any activity listed in clause 12.1 (all of which are also classified as "Prohibited Activities" under clause 11.2), we reserve the right to take the actions set out in clause 13.

12.3 If a Bet is deemed or declared void before an event takes place, the amount deducted from your Account for that Bet will be refunded.

13. Suspension or Termination of Your Account by Us

13.1 If we have reasonable grounds to suspect that you have engaged in any Prohibited Activity, we may suspend your Account without prior notice. During this suspension, you will not be able to access or withdraw funds. Your cooperation in any related investigation is required. We may also notify regulatory or law enforcement authorities.

13.2 If, after our investigation, we reasonably determine that you have not breached our terms, we will lift the suspension. If we determine that Prohibited Activity has occurred, we may restrict or permanently close your Account and notify any relevant authorities or third parties.

13.3 We may also be legally required by competent authorities to restrict, suspend, or close Accounts, which may impact your use of the Services.

13.4 We reserve the right to close your Account for any reason at our discretion by giving at least 14 days’ written notice.

13.5 Any balance at the time of closure will be returned to you, except in the following circumstances:

  • 13.5.1 If your Account was involved in illegal activity, we are not obligated to return funds.
  • 13.5.2 If we determine you participated in Prohibited Activities, we may void affected transactions, withhold winnings or funds, recover bonuses or payouts, and seek repayment of funds already withdrawn that are linked to such activities.

14. Dormant Accounts

14.1 Dormant account rules apply only to users located in the United Kingdom.

14.2 If no activity is recorded on your Account for 24 consecutive months, it will be marked as dormant. You may reactivate your Account by logging in.

14.3 We may reclassify dormant funds internally. Before doing so, we will notify you at your registered email address, giving you at least 30 days’ notice and instructions on how to access your funds.

14.4 Your right to any funds in a dormant account remains intact. Refunds will be issued upon request unless we are entitled to withhold part or all of the balance in accordance with these terms.

14.5 After 7 consecutive years of inactivity, your Account will be deleted, and your personal information will be removed. Refunds can still be requested by providing sufficient evidence of the original balance.

14.6 We do not charge fees for dormant accounts.

Self-Exclusion – Clear Play Analysis Account

15.3 Clear Play Analysis offers a self-exclusion facility to support users who feel they are not in control of their gambling or wish to stop gambling for any reason. To implement this, we may retain essential personal data (such as name, address, and payment information) for as long as necessary, which may be indefinitely.

15.4 To activate self-exclusion, please contact our Customer Services team or visit the Safer Gambling Tools section in your account dashboard.

15.5 Self-exclusion is a joint commitment between Clear Play Analysis and you. During a self-exclusion period, we will take reasonable measures to prevent you from re-opening your Account or opening a new one. You must not attempt to bypass this exclusion.

15.6 You agree not to access or attempt to access any Clear Play Analysis or affiliated accounts during your self-exclusion period. If you have self-excluded on any site operated by Clear Play Analysis or our associated partners (e.g., Sky Betting and Gaming, PokerStars), you must also refrain from registering new accounts with those services. We will take steps to enforce this, but you agree we are not liable for any losses if you bypass self-exclusion. You also agree to notify us if you become aware of any failure in self-exclusion or safer gambling mechanisms.

15.7 Self-exclusion from Clear Play Analysis does not alter your marketing preferences with third parties. You are encouraged to contact third-party advertisers or affiliates separately to opt out of gambling-related content.

15.8 Where possible, Clear Play Analysis will return any account balance at the point of self-exclusion. If a valid payment method is not available, you agree to contact Customer Service to arrange withdrawal. Details of this process will be communicated to you via email upon confirmation of self-exclusion. Any outstanding bets that win after exclusion will be processed in the same manner.

15.9 From 30 December 2016, if you apply a self-exclusion to your entire Clear Play Analysis account, we will attempt to prevent you from accessing any linked account you may hold with Paddy Power for the same self-exclusion period (a "Full Exclusion"). However, due to system limitations, we may not always be able to identify and link such accounts. To ensure full protection, we strongly recommend that you also apply self-exclusion directly to your Paddy Power account and any other accounts you may have. To self-exclude from Paddy Power, please visit their 'Safer Gambling Tools' page or contact the Paddy Power Customer Services team.

15.10 If your Clear Play Analysis (now Clear Play Analysis) account self-exclusion was activated before 30 December 2016, it will not automatically apply to any Paddy Power accounts you hold. In such cases, we advise you to apply a separate self-exclusion via your online Paddy Power account or by contacting their customer service team.

Self-Exclusion and Other Accounts

15.11 If you self-exclude from Clear Play Analysis, Paddy Power, Sky Betting and Gaming, or PokerStars on or after 8 June 2022 (the "Commencement Date") using an all-product self-exclusion, your self-exclusion will automatically apply to any matching accounts held with the listed brands—provided we can verify that the accounts belong to you. If your account with one of these operators is matched or created after your self-exclusion begins, the self-exclusion will be extended to the new account automatically.

If you believe your account was incorrectly matched and a self-exclusion was applied in error, please contact Customer Service. We still recommend that you apply self-exclusion separately on each account you operate. Please note: This automatic cross-brand exclusion process does not apply to Sky Betting and Gaming or PokerStars customers who reside outside the United Kingdom, Gibraltar, Guernsey, Isle of Man, or British Overseas Territories.

Self-Exclusion and The Stars Group Accounts

15.12 On 5 May 2020 (the “Merger Date”), Clear Play Analysis’s parent company merged with The Stars Group, which operates Sky Betting and Gaming (including Sky Bet, Sky Vegas, Sky Casino, Sky Poker, Sky Lotto, and Sky Bingo), Full Tilt Poker, and PokerStars (together the “TSG Brands”).

If you choose to self-exclude from and including 19 December 2025 (the "Commencement Date") with tombola, the self-exclusion will automatically be replicated across Clear Play Analysis (Clear Play Analysis), Paddy Power, Sky Betting and Gaming, and/or PokerStars, provided we can accurately match the account details. The same applies if you self-exclude from any of those operators after the Commencement Date and a match is found on tombola or the others.

We recommend that you still apply self-exclusion individually on all accounts for maximum protection. This clause does not apply to tombola, Sky Betting and Gaming, or PokerStars customers based outside of the United Kingdom, Gibraltar, Guernsey, Isle of Man, or British Overseas Territories. Self-exclusions from accounts outside those territories will not be replicated across the other brands.

Self-Exclusion via GAMSTOP

15.14 If you initiate self-exclusion through GAMSTOP, we will take reasonable steps to prevent you from using your Clear Play Analysis account as soon as reasonably practicable. However, we may be unable to do so in cases where:

  • we cannot match your account details with those provided to GAMSTOP; or
  • there is a technical failure in GAMSTOP’s systems that prevents access to up-to-date self-exclusion data.

Safer Gambling Tools

15.15 If you activate any Safer Gambling Tools on your Clear Play Analysis account (such as Deposit Limit, Product Exclusion, Reality Check, or Loss Limit), those tools will not automatically be applied to your accounts on Paddy Power, Sky Betting and Gaming, Full Tilt Poker, or PokerStars. You must apply the same tools separately on each platform.

For a Full Exclusion across all brands, you must specifically apply a self-exclusion to your entire Clear Play Analysis account. You must notify us immediately if you become aware of any error in the operation of your self-exclusion or any of the safer gambling tools we provide. If you fail to notify us, we are not liable for any resulting losses.

Liability Disclaimer

15.16 Clear Play Analysis shall not be liable for any losses you or any third party may incur if you attempt to bypass our self-exclusion protocols or continue gambling with us or our affiliated partners despite being self-excluded.

16. Liability

16.1 Nothing in these Terms of Use is intended to exclude or limit our liability for:

  • 16.1.1 death or personal injury resulting from our negligence;
  • 16.1.2 fraud or fraudulent misrepresentation;
  • 16.1.3 breach of your statutory rights as a consumer; or
  • 16.1.4 any other liability which cannot be excluded or limited under applicable law.

16.2 As noted in the 'Important Note' at the top of these General Terms, Clear Play Analysis shall not be liable to you, nor do we owe you a duty of care, for our compliance or non-compliance with regulatory obligations (including those relating to safer gambling or social responsibility), to the extent permitted by law.

16.3 Subject to clause 16.1, we shall not be liable for:

  • 16.3.1 losses or damages that were not reasonably foreseeable at the time of your registration or any transaction (e.g., loss of income, profits, business, or data);
  • 16.3.2 losses arising from the accuracy, completeness, or currency of third-party information services (e.g., odds, results, statistics);
  • 16.3.3 losses due to closure or suspension of your Account in line with these Terms; or
  • 16.3.4 losses arising from your breach of the Terms of Use (including Prohibited Activities).

16.4 Subject to clause 16.1, and excluding any winnings validly owed in accordance with these Terms (taking into account our rights to cancel or void winnings under clause 10, the maximum winnings limits in clause 8, and the right to withhold funds under clause 7.7), our maximum liability to you for any single incident or related incidents is limited to the greater of:

  • 16.4.1 the stake amount on the relevant Bet; or
  • 16.4.2 £10,000 (or currency equivalent).

16.5 Right of Set-Off: We may offset any amount in your Clear Play Analysis Account against any amount owed by you to Clear Play Analysis.

16.6 Your Indemnity: You agree to compensate Clear Play Analysis for any losses, charges, or costs incurred as a result of your involvement in Prohibited Activities.

17. Closing Your Own Account

You may close your Clear Play Analysis Account at any time, for any reason. Instructions on how to do so can be found on our Help Centre.

If you choose to close your Account, please ensure you withdraw any remaining funds. Closure is subject to identity verification and settlement of any pending bets. Any outstanding contractual obligations (e.g., investigations under Clause 12 or disputes under Clause 23) will continue beyond Account closure.

18. Additional Terms and Conditions Relating to Betting and Gaming

Introduction

18.1 As a registered Clear Play Analysis user, you may enter into betting transactions via the website, mobile apps, or approved API integrations (collectively, the “Markets” and “Betting Services”).

18.2 Where applicable, Clear Play Analysis operates a betting exchange where users may bet against each other. In such cases, Clear Play Analysis acts as a facilitator rather than a direct counterparty, except in limited circumstances such as:

  • 18.2.1 Bets between Australasian users, including Tote, Fixed Odds, and Multiples bets offered directly by us.
  • 18.2.2 Where Clear Play Analysis Starting Price (“SP”) reconciliation is required to ensure a fair SP outcome.
  • 18.2.3 To enhance market liquidity or reduce high-risk exposure on specific outcomes, particularly in niche or high-profile events.

18.3 Not all Betting Services are available across all channels (e.g., phone betting, API). Please check availability per service.

18.4 References to "Clear Play Analysis", "we", "us", and "our" in this clause refer to the appropriate legal entity providing the Betting Services in accordance with the Terms of Use (Clause 2).

18.5 Betting and gaming are governed by product-specific rules. These are detailed in our:

  • Exchange Rules and Regulations
  • Sportsbook Rules and Regulations

Rules may differ significantly between products. A winning bet on the Sportsbook might be void, dead-heated, or settled differently on the Exchange, and vice versa. Always review the applicable rules before placing bets.

18.6 If any conflict exists between these General Terms and product-specific rules, these General Terms shall prevail unless otherwise stated.

18.7 We determine market availability and closure times at our sole discretion. While we aim to settle all markets promptly, we cannot guarantee settlement times.

18.8 You are solely responsible for accurately entering or communicating bet details. We are not liable for user input errors including stake, odds, or selection mistakes. For telephone betting, once you confirm a bet—even if repeated back incorrectly—you are liable for its outcome.

18.9 You may access up to six months of your transaction history via your Clear Play Analysis Account dashboard. For older data, please contact Customer Service.

Suspension or Voiding of Bets and Markets

18.10 We may suspend betting on any Market at any time, even earlier than otherwise stated in our Exchange Rules and Regulations or Sportsbook Rules and Regulations. In the interest of fairness and market integrity, we may also void specific Bets or entire Markets.

Automated Betting ("Bots")

18.11 Some users employ automated software (or "bots") to place bets based on custom parameters. Such programs may be active in any Market at any time. You should not assume Markets with low apparent activity will remain unmatched. Bot usage is entirely at your own risk, and may be subject to exploitation by other users.

Cancelling Unmatched Bets

18.12 You may cancel unmatched Bets through the Website or by instructing our support team via phone. Cancellation is only confirmed once we send you notice. During the time between your request and our confirmation, your Bet may still be matched partially or in full.

18.13 Editing an unmatched Bet (e.g., changing the odds or stake) is treated as cancelling the original Bet and submitting a new one.

18.14 Unmatched Bets will be cancelled automatically when a Market closes.

Minimum and Maximum Bet Stakes

18.15 Minimum stake requirements apply and vary by product, Market, and currency. You may not place (or attempt to place) Bets below the minimum threshold.

18.16 Your maximum betting limit is the lower of: (i) your “Available to Bet” balance and (ii) your “Exposure Limit” in your Account Summary. Bets placed above applicable limits may still be valid unless otherwise voided under the Terms of Use.

Bet Settlement

18.17 Subject to these Terms and any Specific Conditions, we will settle Markets per our applicable rules. If a Market is incorrectly settled, we may adjust your balance. If this creates a negative balance, you agree to repay it.

  • 18.17.1 If you do not restore your balance within the notified timeframe,
  • 18.17.2 or fail to follow an agreed repayment plan,
  • 18.17.3 or explicitly indicate non-payment intent,

— we may set off your Account balance and/or pursue debt recovery actions.

18.18 All winnings/losses will be rounded to the nearest two decimal places. Amounts ending in 0.5 will be rounded up.

18.19 You must not attempt to manipulate or profit from rounding rules. Such Bets will be cancelled.

Commission and Charges

18.20 Commission is charged based on your net winnings in a Market. It is not based on stakes. Additional charges may apply in specific scenarios—see Clear Play Analysis Charges for full details. We may update these charges per Clause 3 (Amendments).

Clear Play Analysis Community Terms

18.21 Use of the Clear Play Analysis Community or any affiliated forum is subject to our Community Terms and Conditions.

18.22 We are not liable for defamatory or offensive content posted by users in community areas.

18.23 By posting content, you grant us a perpetual, irrevocable license to use or reproduce your posts. We will obtain explicit consent for promotional use of posts.

Casino Games and RNG (Random Number Generators)

18.24 This clause applies to games under the "Casino" tab:

  • 18.24.1 Live Casino games (e.g., Live Blackjack, Live Roulette) use real dealers and physical equipment.
  • 18.24.2 All other games use certified RNG software to ensure fairness and unpredictability.
  • 18.24.3 RNG-based games are independently tested by accredited agencies licensed by gaming authorities.
  • 18.24.4 By playing these games, you agree that:
    • (a) Game results are solely determined by the RNG;
    • (b) They are games of chance—not skill-based;
    • (c) Any animations are for entertainment only and not outcome-determinative;
    • (d) In case of discrepancies, our records will take precedence unless proven otherwise.

Return to Player (RTP)

18.25 RTP represents the long-term theoretical payback of a game. It is calculated by running tens of millions of simulated plays to verify consistency with theoretical values.

18.26 RTP certification is conducted by independent accredited testing bodies per licensing requirements.

18.27 You can find RTP values for individual games in their respective game information pages.

18.28 RTP is an average over time. It is not guaranteed for any single session or player experience.

19. Intellectual Property Rights

19.1 Clear Play Analysis (including its group companies and licensors) is the owner or authorised licensee of all intellectual property rights related to the Services and their content. 19.4 You are not permitted to copy, reproduce, or attempt to replicate the Website, Services, or any part thereof, including but not limited to our software. 19.5 You must not use the Website or Services (or any related software) for any unlawful or prohibited purpose. This includes but is not limited to sending or transmitting content that:

  • (a) infringes our rights or those of third parties, including intellectual property rights;
  • (b) contains viruses or harmful code;
  • (c) is intended to facilitate collusion or fraud;
  • (d) may damage or disrupt the operation of our systems, networks, or those of any third party.

20. Information Services

20.1 From time to time, Clear Play Analysis may provide you with various information services related to betting and sporting events. This may include form data, match results, live scores, event times, elapsed time, streaming services, and other sporting or market-related information (collectively, the “Information”). The Information may be delivered through the Website, mobile applications, emails, or third-party links.

20.2 The Information is either provided directly by Clear Play Analysis or sourced from third parties. While it may be labeled or appear to be “live,” it may be delayed or inaccurate. Other users may have access to faster or more reliable information. You acknowledge and agree that the Information is provided “as is,” and use of this data is entirely at your own risk.

20.3 Links to third-party websites are provided for convenience only and do not imply any endorsement. Clear Play Analysis accepts no responsibility for content or services on third-party sites. Use of such websites is entirely at your own risk.

21. Assignment

You may not assign, sub-license, or otherwise transfer any of your rights or obligations under these Terms of Use without prior written consent from us.

We may assign, transfer, or novate any or all of our rights and obligations under these Terms of Use to another company or legal entity at any time. This includes a transfer within our corporate group or as part of a business sale or restructuring. If such a transfer occurs, we will notify you of the effective date, and your contractual relationship will continue with the new legal entity.

22. Severability

If any provision of the Terms of Use is found by a competent authority to be invalid, illegal, or unenforceable, it shall be modified to the extent necessary to be enforceable, reflecting the original intent as closely as possible.

The remainder of the Terms of Use shall remain valid and enforceable. A provision deemed unenforceable in one jurisdiction will not affect its enforceability in others.

23. Dispute Resolution

In the event of a dispute between you and Clear Play Analysis, both parties agree to follow the procedure outlined in our Dispute Resolution Policy. This policy may be amended from time to time. Resolution processes may include internal review, escalation, or referral to an alternative dispute resolution service where appropriate.

24. Communications and Notices

Any communications or notices you are required to send to us under these Terms of Use should be directed through our Contact Us page or by emailing admin@safeClear Play Analysis.com.

We may send notices to you via email, account notifications, or other contact details provided in your registration. It is your responsibility to keep these details up to date and to monitor your inbox and account for communications.

25. Governing Law and Jurisdiction

25.1 If you reside in the United Kingdom:

  • 25.1.1 These Terms of Use are governed by the laws of England; and
  • 25.1.2 The courts of England shall have non-exclusive jurisdiction over disputes, provided this does not deprive you of any mandatory consumer rights applicable in your country of residence.

25.2 If you reside in Australia or New Zealand:

  • 25.2.1 These Terms of Use are governed by the laws of the Northern Territory, Australia; and
  • 25.2.2 You agree to submit to the non-exclusive jurisdiction of the courts of Australia, without affecting any mandatory consumer protections applicable in your home jurisdiction.

25.3 If you reside outside the UK, Australia, or New Zealand:

  • 25.3.2 You agree to submit to the non-exclusive jurisdiction of the courts of Malta, subject to the preservation of any mandatory consumer protections under your local laws.

26. English Version

The Terms of Use may be translated into languages other than English for convenience. In the event of any conflict or inconsistency between the English version and a translated version, the version that is most favourable to you as the customer shall prevail.

References in these Gaming Conditions of Use to “we”, “us”, “our”, and “Clear Play Analysis” refer to the specific corporate entity within the Safe Pick group that is responsible for the provision of the relevant Game(s), as specified below in the relevant Game-specific terms.

Licence to Use the Software

Clear Play Analysis grants you a limited, non-transferable, non-exclusive licence to download (where applicable) and use the software required to play the Games (the “Software”), strictly in accordance with these Gaming Conditions of Use and all other applicable terms, including the General Terms, Clause 19.

You must not use the Software in any way that violates the Terms of Use. If you become aware of any unauthorised or suspicious use of the Software, you must immediately notify our Customer Services team at support@safeClear Play Analysis.com.

APIs and Automated Play

You must place all wagers through the designated user interfaces available on the Clear Play Analysis Website. Use of automated scripts, “robot” players, or similar software to place bets on Games (including Poker, Casino, Bingo, Exchange Games, or any others) is strictly prohibited—except where explicitly permitted through the use of our officially endorsed API for certain Exchange Game functionality.

Any use of non-endorsed automation tools or unauthorized APIs constitutes a breach of these terms and may result in Account suspension or closure under Clause 13 of the General Terms.

Games Nicknames and Aliases

You may not select a nickname or alias for any Game that is:

  • defamatory, abusive, or offensive;
  • pornographic or obscene;
  • intended to impersonate a real individual or brand.

Clear Play Analysis reserves the right to modify or remove any nickname or alias that breaches this clause, without notice. Continued misuse may lead to further action under our Prohibited Activities policy (Clause 11 of the General Terms).

Changes to Games

We may modify, withdraw, or replace any Game at any time. This includes changes to gameplay features, visuals, specifications, or other characteristics.

However, if such changes could affect an ongoing promotion or bonus offer, Clear Play Analysis will:

  • (i) Notify affected users with reasonable advance notice; and
  • (ii) Provide a suitable alternative or adjustment to ensure users are not unfairly disadvantaged.

Our goal is to protect your experience and ensure promotional fairness in the event of product changes.

Game Help

Each Game available on Clear Play Analysis includes a dedicated Game Help section explaining how the Game is played, including rules, payout mechanics, and relevant options. We strongly encourage you to read these instructions prior to participating in any Game.

By engaging in a Game, you acknowledge that you understand and accept the Game rules as published.

Random Number Generator ("RNG")

Clear Play Analysis uses certified Random Number Generator (“RNG”) software to ensure that all Game outcomes are entirely fair and random. The RNG software is designed to generate number sequences with no predictable pattern, ensuring that every spin, card draw, or result is unbiased and independent of previous outcomes.

Each Game that relies on RNG software is tested and certified by an independent, accredited testing agency acting on behalf of the relevant gambling licensing authority. Only Games that have passed this testing are made available to play on our Website.

By playing any Game that uses RNG, you acknowledge and agree to the following:

  • The outcome of each Game is solely determined by the RNG.
  • RNG-based Games are classified as games of chance, and outcomes are predetermined at the moment you initiate the play (e.g., press "spin" or "start"). Your skill or judgment does not affect the result.
  • Visual animations and effects shown during gameplay are for entertainment purposes only and do not influence or reflect the actual result of the Game.
  • The prize amount (if any) recorded in our internal systems is final. In the event of any discrepancy between what is shown on your screen and what is recorded in our systems, our records will prevail—unless you can provide conclusive evidence to the contrary.

Return to Player ("RTP")

The Return to Player (“RTP”) percentage represents the long-term theoretical payback rate of a fixed odds Game, expressed as a percentage of the total amount staked. For example, an RTP of 95% means that, on average, £95 is returned to players for every £100 wagered—over a very large number of plays.

For certain Games, the theoretical RTP is verified by simulating millions of plays—typically 10 million—to ensure statistical consistency. These results are generated using RNG software, ensuring randomness in each individual game outcome.

Both RNG and RTP testing are conducted by independent, accredited testing houses approved by the appropriate licensing bodies (such as the Malta Gaming Authority). Our Games are only certified and offered once compliance is confirmed.

RTP values for each Game are disclosed in the relevant Game’s information or help page.

For the avoidance of doubt, RTP percentages are statistical averages based on large-scale testing. They are not a guarantee of individual experience or results over a small number of plays. RTP does not ensure any payout on any single play, hand, or spin.

Clear Play Analysis warrants that all Games offered comply with the RTP requirements of all applicable regulatory bodies, including but not limited to the Return to Player Directive 2016 issued by the Malta Gaming Authority.

Peer-to-Peer Games

Certain Games available on the Clear Play Analysis platform involve peer-to-peer gameplay, where you compete directly against other users of the Website. These include, but are not limited to, certain Poker Games and multiplayer Casino or Exchange Games.

Please note that Clear Play Analysis has no control over the actions of other users and cannot guarantee that all participants will act fairly. Activities such as collusion, the use of unfair external aids, or fraudulent practices may occur despite our monitoring systems.

If you suspect any form of cheating, collusion, or unfair behaviour, please report it to our support team at support@safeClear Play Analysis.com as soon as possible. While we will take all reasonable steps to investigate and prevent such activity, we are not liable for any losses or damages caused by third-party misconduct.
